1.0 OVERVIEW
1.1 We may change these Terms and Conditions from time to time, but we will always post these changes on our website and a note will be put at the entrance to the gym. Members are respectfully reminded of their obligation to observe all rules and conditions and to make every effort to comply with any reasonable request made by a Pacefit Limited Manager.
1.2 This agreement commences once you have indicated your acceptance in the assumption of liability and decloration.
1.3 This agreement will become binding on you and us upon confirmation of your membership application being accepted, at which point a contract will come into existence between you and us.
1.4 You are entitled to all rights and privileges for the type of membership chosen.
1.5 You cannot transfer this membership to anyone else.
2.0 CHARGES
2.1 The Joining Fee (if one is payable) and the first month's or 6 month upfront payment will be collected upon application for membership. Joining fees are applied to cover the initial administration costs associated with setting up a new membership and entitle members to booking privileges, induction session, workout programmes and selected product discounts.
2.2 Monthly membership payments to be paid via standing order or card transaction. All card transactions will be rata'd to the applicable monthly fee and membership is valid until the date of month the agreement commenced in the following month.
2.3 You agree to advise us immediately of any changes to the member details provided.
3.0 TERMINATION
3.1 You may terminate your membership at any point by cancelling your standing order and providing 7 days notice, in the form of email or written letter. For card transactions please provide 7 days notice also in the form of email or written notice. For 6 month Fixed Term Membership, you will be entitled to 50% of the pro rata'd amount as refund for any unused membership.
3.2 In the above circumstances your membership will remain in force until the day before your next payment is due, at which point it will automatically terminate.
4.0 MONEY BACK GUARANTEE
4.1 As per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you are entitled to cancel your membership and receive a full refund of any fees paid within 14 days of completing yourmembership application form. However, as per regulation 36 of Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you select to commence your membership immediately, or you ask us to start your membership early, you agree that if you subsequently cancel your  membership within the 14 day period, you will be refunded any monies paid, less an amount for the membership you have already used commencing from the first day after joining.
5.0 DAY PASS / PAY AS YOU GO
5.1 The Day Pass / Pay As You Go Option commences once you have indicated your acceptance in the  declaration section of this document.
5.2 Your session and usage will be activated on the date specified upon completion of this document, running till midnight of the specified date.
5.3 You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
5.4 You cannot transfer this daily membership to anyone else nor transfer to another date.
5.5 Day Passes / Pay As You Go Usage is non refundable
6.0 MISCELLANEOUS TERMS
6.1 Members must be 16 Years of age or older
6.2 You agree to adhere to all rules of membership which are displayed at Pacefit or included in this form regarding usage, opening times, your conduct and behaviour. We may at times make reasonable changes to these rules at any time, provided we give you advanced notice.
6.3. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
6.4 There may be occasions where we have to close all, or part of, the gym of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavours to ensure closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part, or all of, your fees in such circumstances.
6.5 We will not be liable or responsible for outstanding monies paid to a Personal Trainer. Personal Training  is arranged directly with the PT and not with Pacefit Limited.
6.6 As a consumer, you have legal rights in relation to any services that are not carried out with reasonable skill and care, or if the materials we use are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms will affect  these legal rights.
6.6 This agreement is governed by English Law.
6.7 Pacefit reserves the right to terminate this agreement with immediate effect upon notifying you if you are in breach of club rules.
6.8 To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort,  wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.

PACEFIT USER & GYM RULES


• On joining, all members are offered a comprehensive induction to instruct you on the use of the gym equipment. You are strongly advised to undertake this. Pacefit Limited will not accept any liability for any claim for personal injury if you use the gym equipment having not undertaken an induction from a qualified member of Pacefit staff.
• Induction bookings can be made via phone, email or booked upon membership sign up.
• If you are unsure as to how to use any piece of equipment you must seek advice from a qualified member of Pacefit Limited before use such equipment.
• For safety reasons, bags are not permitted on the main gym floor (store under stairs) and correct attire must be worn when exercising i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as jeans, boots, flip-flops/sandals or work wear are not permitted.  Any member not wearing suitable attire may be asked to leave the gym.
• You may not use the gym whilst under the influence of alcohol, narcotics, tranquilizers or any medication or other substance which may affect your ability to exercise safely. Pacefit reserves the right to remove you from the facility if it reasonable believes you are unfit to use the equipment, gym or classes.
• We would encourage members to use towels on the gym floor, but please do not leave these on equipment, If you do not possess a towel, wipes and antibacterial spray are available.
• Ensure that you put your weights back in their original place when finished, failure to do so may result in your membership being terminated.
• Please do not misuse the equipment or weights by dropping them on the floor, failure to do so may result in your membership being terminated.
• Please do not take photographs/videos on the premises or post remarks to the internet that may identify another member.
• You must not behave in an aggressive, abusive, anti-social or threatening manner to any staff or member, any one doing so will have their membership terminated immediately and Pure Gym reserves the right to contact the Police if deemed necessary.
• Only Pacefit registered personal trainers are permitted to train members / external clients in the Gym. Anyone else undertaking personal training or coaching will be asked to leave the gym immediately.
• Members are solely responsible for their own belongings whilst visiting Pacefit. Pacefit Limited accepts no responsibility for any loss or damage to personal property.
• Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item held in lost property. Such items will be kept until claimed, but for no longer than one month after which time the items will either be donated to charity or destroyed.
• Members must inform Pacefit Limited of any change of contact and email address or telephone numbers. These changes can be made in the facility by contacting a member of staff or sent over via an email to contact@pacefit.co.uk.
By accessing the gym and using the gym equipment members are deemed to have read and understood the terms and conditions of membership.
• Should your Physical Activity Readiness Questionnaire result in you being required to discuss your intention to exercise with your doctor, please be aware that your subscription remains active and any fees collected are non-refundable.
• Smoking, including e- cigarettes are strictly prohibited in all areas of the gym. Any member found to be breach of this rule may have their membership terminated.
• Members may not bring any pets (other than official aid dogs) into the gym.
